Terms Of Use (applies to all downloads, purchased or given as a freebie):

***Ok, let's be frank, not Frank. I designed these things, so please treat them with respect. Do not give them out or distribute them as if they were your creations. Because, well, you weren't up until the wee hours of the morning working away on them. These are intended for personal use only. Please read below for a little clarification.

1. I try to be pretty reasonable with the TOU. If you are going to be using them for your own scrapbooks that is perfect.

2. If you are making Grandma or Aunt Betty an album for a gift or just because they are not sure how to turn on the computer let alone scrap with it- that is perfect, too.

3. If you are burning Grandma a disk so she can have a copy- that would be WRONG, as in stealing. I know it seems funny, but I see gifts of your time as a valuable thing to Grandma and I will allow you to help her, but I won't allow you to take my product and give it away. She should get her own copy if she wants to have it on her computer, once she knows how to turn it on of course.

4. If you are going to make cards for the holidays or Timmy's birthday party- perfect. Or candy wrappers, or cute little hybrid crafts that you are selling at a boutique, sure, go ahead.

5. If you are making cards that you intend to sell- you are still ok, as long as you are not distributing them through a website store.

6. If you do Scrap For Hire (S4H) or Scrap For Others (S4O) where you sell your finished product to a client I am ok with that with the exception of my templates, quick pages or albums. You have to do the creating or I want a share of the profit! Also, please make sure that your client only receives a finished merged piece. No loose parts hanging out for them to re-use. Because that would be considered redistributing. And don't make any freebies. I think if you spent your time creating something you ought to get a little respect. And you can tell your client I said so.

7. You can make a backup of the files. Maybe make a couple and put one on an external drive. We know the drives fail and the kids use the disks for frisbees, so make a couple backups and maybe put one in a fire proof vault. Just remember they can't be given as a gift because that would be wrong.

8. I don't care if you have them on multiple computers as long as those computers all belong to you and are located in the same house or dwelling. If you scrap at work and need a copy there, please let me know. I'd like to know what job you have that allows you to scrap while at work. I may want to get a job like that.

Things you may NOT do:

1. Again, giving the copies of the files away is wrong. We all know that, but for some reason a few people think they can ignore their consciences and do this anyway. We call that stealing. Stealing is wrong. Please don't do it. I don't charge much for my kits, and if your friend or relative can't afford it maybe we can workout a trade.

2. Don't distribute my files in any way. Redundant? Yeah. So sharing them through yahoo or google or any other group, or cell phone, or any other electronic device or means is wrong. Uploading them to 4-shared or any other file sharing site would be wrong, or potentially bad. I prefer you back up to a cd or external. Lots of naughty people go file hunting at night and I wouldn't want them finding your goodies.

3. Unless you bought a Commercial Use product you may not create anything for commercial use. And considering that you have this set of TOU you did not get the Commercial Use version. E-mail me if you meant to and we'll fix that.

4. Don't offer these files to anyone for any reason.

5. Do not use the files to design any blogs or websites that are not for yourself or really special immediate family members. If you really really really want to do this please let me know by e-mail and I will look at what you are wanting to do. Chances are that unless you do that for a living I will approve it. Just please let me make the decision. If you are paid, as in this is your job, then that would be commercial use and would require a license as stated below.



Crediting April Staker

1. Ok, I know how hard it is to remember to do this, or if you have a long list of supplies you can easily forget who made what. So, if you remember I would appreciate you mentioning that you used my kits when you make a layout and post it in a public gallery. Or if you make anything S4H or S4O, I would really appreciate it. Or if you just love my stuff you could shout it out to all of your friends and neighbors. That would really be awesome, especially if they are into digi scrapping, too. The more customers I have the lower I can make my prices. So we kind of help each other out that way, see? I don't want to be the Versace of scrapping. I want to be affordable. And if I can sell more kits cheaper I will do that. But I need help with the advertising becase there are billions of people to reach and I just can't do it alone!


Misc. Items:

1. Photographers and Web/Blog Designers- you must purchase a license from me to use my kits in creating cards, frames, story boards, etc. Sorry, this is commercial use. I offer a one kit license for $25 (per kit, does not expire) or you can buy a one year license for $100 and that allows the license to be used with any kits purchased during the 12 months following the purchase of the license.

I would like to thank the fine people who make the Dr. Pepper and Vault zero that allows me to thrive on less sleep and not be extra grumpy.

And I should thank my kids and hubby who put up with me never watching tv even though the shows are really, really cool. I would rather be designing. And I want to thank all of you who purchase my designs. I am trying to pay for my back to college experiment with as much cash as possible. And so the money I earn from designing is helping me to go back and finish the degree I started ages ago. And someday, when I am an art teacher I will have to thank all of you! Besides, you keep me doing this even on the weeks when I end up in the negative because I over spent on advertising that didn't work.

And I should thank God for my talents and also for creating the cocoa bean because I know it was a vegetable in the beginning.
